CASE SUMMARY

On December 30, 2021, a group of Georgian voters filed a federal lawsuit against Georgia's Secretary of State and the members of Georgia's State Election Board, challenging the state's enacted congressional redistricting plan as violating the federal Voting Rights Act. The plaintiffs allege that the enacted plan purposefully packs and cracks Black populations in the northwestern and western regions of Atlanta which could otherwise be drawn into an additional majority-minority district, thereby diluting their voting strength in violation of Section 2 of the VRA. They are seeking a judicial declaration that the congressional plan violates the Voting Rights Act, an injunction barring the defendants from using the plan in any future elections, and for the court to cause the adoption of a valid redistricting plan that includes an additional majority-minority district in the western Atlanta metropolitan area.
