CASE SUMMARY
On March 11, 2022, a group of Missouri voters filed a lawsuit against Missouri's Secretary of State challenging the state's lack of a new congressional redistricting plan as violating the Missouri Constitution. Plaintiffs allege Missouri's congressional redistricting plan from the previous decade has since become malapportioned in violation of the one person, one vote constitutional requirement under Article III, Section 45 of the Missouri Constitution, and that due to an impasse between the Missouri General Assembly and Governor, the state will be unable to enact a new congressional redistricting plan in time for the 2022 primary and general elections. They are seeking a judicial declaration that the state's current congressional districts configuration violates the Missouri Constitution, an injunction barring the defendant from using the plan in future elections, and a court order establishing a schedule for the court to adopt and implement a constitutionally apportioned plan for use in the 2022 elections.
Plaintiffs voluntarily dismissed the case on May 20, 2022.
