CASE SUMMARY

On March 1, 2022 a sitting Pennsylvania state Senator filed a petition with the Pennsylvania Supreme Court challenging the Pennsylvania Legislative Reapportionment Commission's adopted legislative plan as violating the state constitution. The petitioner's claims focused on the Senate districts in the Lehigh Valley, which she asserted excessively and unnecessarily divided the region's political subdivisions for political purposes in violation of article II, ยง 16 of the Pennsylvania Constitution. She sought a judicial declaration that the adopted plan violated the Pennsylvania Constitution and a court order remanding the plan back to the Commission to revise it so as to avoid any subdivision splits that are not absolutely necessary.

On March 16, 2022 the Pennsylvania Supreme Court issued an order upholding the adopted legislative plan as constitutional and dismissing all of the petitions challenging it.
