CASE SUMMARY

On July 27, 2022, two Missouri voters filed a state lawsuit against Missouri’s Secretary of State and the state’s Judicial Redistricting Commission challenging the Commission’s adopted state Senate plan as violating the Missouri Constitution, citing the plan’s splitting of Buchanan County and the City of Hazelwood. They sought a declaratory judgment the plan was unconstitutional, an injunction barring its use in future elections, and an order adopting the plaintiffs’ proposed remedial plan.

  • On July 12, 2023, a bench trial was held in the Circuit Court of Cole County. On September 12, 2023, the circuit court upheld the state Senate plan as constitutional. Plaintiffs appealed directly to the Missouri Supreme Court.
  • On February 14, 2024, the Missouri Supreme Court affirmed the circuit court’s decision.
