On May 6, 2020, Fair Maps Nevada filed a federal lawsuit against Nevada’s Secretary of State challenging the state’s failure to amend their ballot measure signature deadline and in-person signature requirements in light of the COVID-19 pandemic as imposing undue burdens on their rights to political association and participation under the U.S. and Nevada Constitutions. They sought an injunction extending the deadline for gathering initiative petition signatures and granting permission to collect electronic signatures.
- On May 21, 2020, the district court held a virtual hearing on the plaintiffs’ request for injunctive relief.
- On May 29, the district court partially granted the plaintiffs’ request for injunctive relief, extending the signature gathering deadline to August 5, 2020, but declining to allow the collection of electronic signatures.
