On August 27, 2020, Paul Goldman, formerly the chairman of Virginia's Democratic Party, filed suit against the Virginia State Board of Elections in the Supreme Court of Virginia. The plaintiff contends that the language of Proposed Constitutional Amendment #1 was misleading and is intended to deceive voters because it fails to describe how commissioners will be selected. The case was dismissed on the merits on September 9, 2020.
