CASE SUMMARY
On July 27, 2020, a group of non-profit organizations filed a federal lawsuit against then-President Donald Trump challenging his Executive “Memorandum on Excluding Illegal Aliens From the Apportionment Base Following the 2020 Census” as violating the U.S. Constitution’s Enumeration Clause, the Census Act, and the Administrative Procedure Act, as well as being racially discriminatory in violation of the 14th Amendment’s Equal Protection Clause. They sought declaratory and injunctive relief barring the President and Secretary of Commerce from implementing the memorandum’s plan.
- On January 12, 2021, the plaintiffs voluntarily dismissed all of their claims, and the district court dismissed the action the following day.
