CASE SUMMARY
On December 12, 2022 Michigan's Independent Citizens Redistricting Commission filed a lawsuit against the Michigan House of Representatives and Senate challenging the Commission's lack of funding for its fiscal year 2023 operations as violating the state constitution. The Commission asserts the Legislature failed to make sufficient appropriations for the Commission to be able to carry out its duties in violation of article IV, ยง 6(5) of the Michigan Constitution and they are seeking a declaratory judgment that the Michigan Legislature failed to meet its constitutional obligations and a permanent injunction and writ of mandamus requiring the Legislature to appropriate the Commission's requested funding.
The case was dismissed on March 16, 2023.
