CASE SUMMARY

The states of Kansas, Louisiana, Ohio, and West Virginia brought this suit on January 17, 2025, alleging apportionment should be on the basis of citizenship not residency. The states requests the Residence Rule be declared unlawful, declaring any apportionment that does not exclude illegal aliens and nonimmigrant aliens as unconstitutional, set aside the Residence Rule, enjoin the Department of Commerce and Census Bureau to include questions on citizenship and legal status on the 2030 Census and all censuses that follow, and remand the case to the Department of Commerce and Census Bureau for the issuing of constitutional rules.
