Case Summary
On February 28, 2020, two registered voters from Oklahoma brought a case to the Oklahoma Supreme Court challenging Initiative Petition 426's placement on the ballot, which contains an amendment to the state constitution that would give responsibility for congressional and legislative redistricting to an independent redistricting commission. The plaintiffs argued that the initiative's ballot summary (gist) inaccurately describes the proposed commission's appointment and map drawing procedures and rules. Although the Oklahoma Supreme Court had ruled against the original language of the Petition in the earlier case Newberry v. Moore, the plaintiffs contend in this case that the language as amended is still inaccurate and misleading.
Oral arguments were held on March 17, 2020. On May 27, the Oklahoma Supreme Court ruled in favor of the defendants finding that the language as amended was legally sufficient.
