Case Summary

On January 30, 2026, the state of Missouri sued the Commerce Department alleging the 2020 Census and 2021 Apportionment violated Section 2 of the Fourteenth Amendment; Article II, § 1 of the United States Constitution; and the Administrative Procedures Act. The complaint further alleges that absent relief the same violations will occur in the 2030 Census and 2031 Apportionment. The state of Missouri requested a declaration that the Census should not have included illegal aliens and temporary via holders in the 2020 apportionment base and should not do so again in 2030. Missouri goes further to request the Commerce Department redo the 2020 apportionment.
