Case Summary
On May 18, 2020, a lawsuit was filed in the Circuit Court of Cole County, Missouri. The eight Missourian plaintiffs argued that the summary of Senate Joint Resolution 38 (Missouri Amendment 3) failed to adequately describe the ballot measure's language. The plaintiffs petitioned the court to forbid the defendant's summary from appearing on the ballot and instead use a summary prepared by the plaintiffs or the court.
On August 17, judgment was issued favoring the plaintiffs. The Court found the summary to be "insufficient and unfair" and permitted the plaintiffs' summary to be placed on the November 2020 ballot.
