CASE SUMMARY

On December 4, 2023, plaintiffs brought a federal lawsuit under the 14th and 15th Amendments alleging unconstitutional racial gerrymandering. They seek a judicial declaration that the plan is unconstitutional, an injunction barring the plan from use in future elections, and for the court to require a new, lawful plan be enacted.

A three-judge panel of the Middle District consolidated N.C. NAACP v. Berger with Williams v. Hall on March 18, 2024.

The three-judge panel issued an opinion on November 20, 2025, upholding North Carolina's 2023 house, senate, and congressional maps. The panel withheld judgement on NC-01 and NC-03 as drawn in the 2025 redraw. On November 26, 2025, the panel released an opinion and order denying a preliminary injunction to the new NC-01 and NC-03.
